MSA Allocations
The Centers for Medicare & Medicaid Services (“CMS”) has developed a set-aside process to ensure compliance with the Medicare Secondary Payer Statute (“MSP”). This process has inhibited the resolution of many workers’ compensation claims and created uncertainty within the industry. 1st Review’s goal is to facilitate the most cost-effective, timely, and fair allocations that CMS will allow.
To ensure compliance with the MSP and to allow for the most economical allocations, 1st Review brings together a unique blend of legal, medical, and insurance expertise to provide both pre-settlement and post-settlement Medicare Set-Aside services. Settling cases and satisfying Medicare does not need to be an expensive or difficult task. 1st Review simplifies the MSA process for all parties involved by ensuring:
- All referrals are reviewed by a Medicare Set-Aside Consultant-Certified (“MSCC”) practicing workers’ compensation attorney. This process delineates issues so as to eliminate excessive MSA funding.
- 1st Review’s staff will determine on a claim by claim basis what steps must be taken to comply with the MSP. 1st Review is mindful of the relevant legal and medical issues; we perform allocations and submit them to CMS only when necessary.
- All relevant parties receive immediate communication with extensive follow-up to ensure that the MSA process moves forward in an organized and timely manner. We can also assist in establishing medical fund management after approval is obtained from CMS.
